Offences and Penalties.

1.1. Requirements for permits, licences and certificates
Importation or exportation of any plant, animal, carcass, fish, agricultural produce, soil or microorganisms without a permit, licence or certificate. If a breach under this Act, shall on conviction be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding six years or to both and for a second or subsequent offence to a fine not exceeding one hundred and fifty thousand ringgit or to imprisonment for a term not exceeding seven years or to both.

1.2. False permit, licence or certificate
Furnishes or causes to be furnished orally or in writing, of any permit, licence, certificate, or other document or information required to be furnished under this Act, which is false, inaccurate or misleading upon importing or exporting any plant, animal, carcass, fish, agricultural produce, soil or microorganisms, commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years or to both and for a second or subsequent offence to a fine not exceeding seventy-five thousand ringgit or to imprisonment for a term not exceeding five years or to both.

1.3. Plants, animals, carcasses etc. with carrying pests, diseases or contaminants
Any import of plants, animals, carcasses, food products, soil or microorganisms through the entry points, quarantine stations and quarantine premises;
  • threatens, obstructs, blocks or harasses any enforcement officers enforcing their authority under this Act;
  • recover or attempt to recover any plants, animals, carcasses, food products, soil, microorganisms or any other items confiscated under this Act; or
  • prior or after the confiscation causes a loss, or damaging or destroying any plants, animals, carcasses, food products, soil, microorganisms or any other items,
1.4. Import and export regulations
Importing or exporting any plants, animals, carcasses, food products, soil or microorganisms must comply with all import regulations as stated in the permit, licence or statement, or export regulations as stated in the permit or licence. Anyone caught violating this Act is committing an offence and can, when convicted, be fined not exceeding one hundred thousand ringgit or jailed not exceeding six years or both and for second offence or subsequently fined not exceeding one hundred and fifty thousand ringgit or jailed not exceeding seven years or both.

1.5. Breaking, tampering or damaging the seal, etc.
Any person, without proper authority, breaking, tampering or damaging the seal or transferring the books, records, documentations, equipments, any plants, animals, carcasses, fish, food products, soil or microorganisms, permits, licences, statements, or any other items sealed or attempting to commit such act is committing an offence and can, when convicted, be fined not exceeding ten thousand ringgit or jailed not exceeding six months or both and for continued offences fined not exceeding one thousand ringgit for each day or portion thereof from the day the offence continues after conviction.

1.6. Obstructing enforcement officers
Any person who;
  • carrying pests, diseases or contaminants
  • believed to be carrying pests, diseases or contaminants
  • ravaged by pests, diseases or contaminants is committing an offence and if convicted, will be fined not exceeding one hundred thousand ringgit or jailed not exceeding six years or both and for second offence or subsequently fined not exceeding one hundred and fifty thousand ringgit or jailed not exceeding seven years or both.
Is committing an offence, and when convicted, can be fined not exceeding one hundred thousand ringgit or jailed not exceeding six years or both, and for second or subsequent offences a fine not exceeding two hundred thousand ringgit or jailed not exceeding seven years or both.
